1. Overview
This website, novairelighting.shop, is operated by NOVAIRE ("NOVAIRE," "we," "us" or "our"). These Terms of Service ("Terms") apply to everyone who visits the site or buys from us. By using the site or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy and Shipping Policy, which are part of these Terms. If you don't agree with these Terms, please don't use the site.

2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. We currently sell and ship only to addresses in the United States.

3. Products and descriptions
We sell modern indoor and outdoor lighting fixtures. We work to describe and photograph every product accurately, including sizes, finishes, wattage, light color and waterproof ratings. Even so, colors and finishes can look slightly different depending on your screen, and measurements and specifications are approximate and may vary slightly between production batches. Some photos show fixtures in styled or illustrative settings. The product you receive is the fixture described on the product page, not the surrounding scene. If a product you receive isn't as described, see Section 10.

4. Pricing and availability
All prices are in U.S. dollars. We may change prices, products and promotions at any time without notice. Price changes don't affect orders we have already confirmed. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any orders placed at that price. If your payment has already been charged, we'll refund you in full. Products are available while supplies last, and we may limit quantities or decline any order at our discretion.

5. Orders
Your order is an offer to buy. We accept it when we send you a shipping confirmation. We may cancel an order before it ships, for example if a product is unavailable, if there is a pricing error, or if we suspect fraud. If we cancel, we'll refund any amount charged. You can cancel your own order for a full refund within 24 hours of placing it, as long as it hasn't shipped.

6. Payment
We accept the payment methods shown at checkout. Payments are processed securely through Shopify and its payment partners. By placing an order, you confirm that you're authorized to use the payment method you provide.

7. Shipping
Shipping costs, processing times and delivery estimates are described in our Shipping Policy. Delivery dates are estimates, not guarantees. Risk of loss passes to you when the carrier delivers your order to the address you gave us.

8. Returns and refunds
Returns, exchanges, damaged items and refunds are covered by our Refund Policy. In short: you can return unused items in their original packaging within 30 days of delivery, and we'll replace or refund items that arrive damaged, defective or not as described.

9. Installation and electrical safety
Many of our fixtures are hardwired and must be connected to your home's electrical system. We strongly recommend installation by a licensed electrician, following local building and electrical codes. Always turn off power at the breaker before installing or servicing a fixture, follow the instructions included with your product, and use each fixture only as intended. Don't exceed its rated wattage or use an indoor-only product outdoors. NOVAIRE is not responsible for damage, injury or loss caused by improper installation, modification, misuse, or failure to follow instructions or local codes.

10. Product warranty
If your fixture arrives damaged, stops working, or isn't what you ordered, contact us within 30 days of delivery and we'll send a replacement or give you a full refund, as described in our Refund Policy. Except as stated in these Terms and our Refund Policy, and to the fullest extent permitted by law, products are provided "as is." We disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some states don't allow limits on implied warranties, so some of these limits may not apply to you.

11. Limitation of liability
To the fullest extent permitted by law, NOVAIRE and its owners, employees and partners are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or our products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Reviews, comments and feedback
If you submit reviews, photos, comments or suggestions, you give us permission to use, display and share them in connection with our business, without payment to you. You agree that your submissions are your own, are truthful, and don't violate anyone's rights or any law. We may remove any submission at our discretion.

13. Intellectual property
All content on this site, including text, product names, logos, graphics, photos and design, belongs to NOVAIRE or its licensors and is protected by copyright and trademark laws. You may not copy, reproduce or use it for commercial purposes without our written permission.

14. Prohibited uses
You agree not to use the site to break any law or regulation; place fraudulent orders or use payment methods you're not authorized to use; upload viruses or harmful code, or interfere with the site's security or operation; collect other users' personal information; or copy, scrape or resell our content or products without permission.

15. Third-party links and services
The site may link to or use third-party services, such as payment processors, shipping carriers and social media. We aren't responsible for their content, policies or practices. Your use of those services is governed by their own terms.

16. Indemnification
You agree to indemnify and hold NOVAIRE harmless from any claims, losses or expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the site or our products.

17. Governing law
These Terms are governed by the laws of the State of Minnesota and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Minnesota, unless applicable law requires otherwise.

18. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Continuing to use the site after changes are posted means you accept the updated Terms.
